SELLERS

Concrete Equipment Inc. and www.ConcreteEquipmentInc.com does not charge a listing fee to post an item on ConcreteEquipmentInc.com. If an item sells using ConcreteEquipmentInc.com it is the sellers responsibility to then pay Concrete Equipment Inc. the commission/broker fee incurred. ConcreteEquipmentInc.com charges a standard minimum % fee on all sales. If a set commission is requested/required by the seller then both the seller and ConcreteEquipmentInc.com must agree upon a flat rate commission regarding the sale of any item in writing prior to the completion of the sale. If the seller wants a specific dollar amount in return to sell an item on ConcreteEquipmentInc.com that amount must be specified in writing prior to the sale, once agreed upon any amount over the specific return amount to the seller will be considered the broker fee for using concreteEquipmentInc.com. ConcreteEquipmentInc.com reserves the right to acquire a deposit from buyers. ConcreteEquipmentInc.com reserves the right to obtain broker fees from a purchase deposit acquired from a buyer. The seller is not responsible for commission / broker fees if the unit sells to a third party* during the time of posting on ConcreteEquipmentInc.com . *Third Party buyers shall not have any prior contact or correspondence with Concrete Equipment Inc. or ConcreteEquipmentInc.com including anyone employed by Concrete Equipment Inc. regarding the sale of the specific item. This includes Phone conversations, viewing items on concreteEquipmentInc.com. Listings on eBay.com paid for by ConcreteEquipmentInc.com. Publications paid for by ConcreteEquipmentInc.com. Fliers / Photo's distributed by ConcreteEquipmentInc.com. www.ConcreteEquipmentInc.com this agreement is binding 1) you fill out a form / contract sent to you by Concrete Equipment Inc. 2)you submit an email or receive and agree to an e-mail with the amounts disclosed 3) facsimiles are exchanged with dollar/commission amounts. If a seller backs out or cancels an agreed sale after a deposit has been retained regarding the specific machine the seller of that machine is responsible for full payment and reimbursement of all costs including but not limited to advertising, photography, photo editing, eBay fees, travel, related labor, bank charges, vessel/airfare deposits and full broker fee or agreed commissions to Concrete Equipment Inc.

BUYERS

Concrete Equipment Inc and www.ConcreteEquipmentInc.com does not warranty any used item bought or sold. All new items fall under manufacture's warranty and Concrete Equipment Inc. will assist with manufactures warranty issues. All equipment is sold as-is no warranty unless a written agreement is agreed upon prior to the completion of the sale. All Items are sold F.O.B. individual locations and transportation is additional if not agreed upon in writing prior to the completion of the sale. Immediate wire transfer or cashiers check is the preferred method of payment. If Pay-Pal or credit card is used for payment additional fees may apply in some cases the buyer may be responsible for closing cost. When using a cashiers check we reserve the right to place a hold on the removal of equipment until the payoff amount of the check clears. It is the buyers responsibility to provide Concrete Equipment Inc. with documentation of export or CA sales tax may apply.

GENERAL

Known to all parties that Concrete Equipment Inc. a corporation organized and existing by virtue of the laws of the state of California (Encinitas 92023) All sales, referrals, transactions, e-mails, phone calls, fax's and sales related correspondence is positioned at this region. Photographs posted on www.ConcreteEquipmentInc.com bearing the www.ConcreteEquipmentInc.com watermark logo are the sole property of Concrete Equipment Inc. and cannot be redisplayed, reprinted or defaced without the prior written consent from Concrete Equipment Inc. Check local county, state, country, province laws when acquiring equipment. All sales are final.

AUCTIONS

Concrete Equipment Inc is not responsible for final value fees unless stated in writing prior to any auction. If an item is placed on any auction the seller must abide by and respect the rules and regulations regarding that venue.

DEPOSITS

General deposit required to hold / secure a machine is 10%. Depending on the status of the machine their is two deposits available. 1) Operating deposit: An operating deposit is intended for a machine that is currently operating and the owner must remove the machine from service and prepare for final sale. If a buyer decides not to purchase the agreed machine after a operating deposit has been made on an operating machine the amount of daily revenue lost will be pro-rated from the deposit plus any fees incurred with the remaining balance returned 2) Non-operating deposit: A non-operating deposit is made that machine is currently not being used and is ready for sale. If a buyer decides not to purchase the agreed machine after a deposit has been made on a non-operating machine the deposit shall be refunded minus any fees incurred.

Deposits made on machines are valid for 30 days from the date received unless other wise stated to all parties in writing. If an extension is required it must be made in writing prior to 11:59PM on the 30th day. If an extension is requested and approved depending on the severity of the time delay the buyer might incur some penalties and or fees. After thirty(30) days if the buyer has made no communication with Concrete Equipment Inc. Deposits will be forfeited. All items must be paid for in full prior to removal, delivery or shipment.
